A creditor can file a Civil Action against you in District Magistrate Court or the Court of Common Pleas in the County where you reside or the County where the transaction originally took place.
What can a creditor do to me if judgment is granted in his favor?
If the creditor is granted judgment against you, he can force Sheriff Sale of certain personal items or real estate in an attempt to satisfy the amount of the judgment. He is also entitled to accrued interest on the judgment amount until it is satisfied.
Does a creditor always have to obtain judgment against me to recover?
No! Automobiles, Mobile Homes and various other items that are financed can be repossessed and re-sold by the creditor if you are unable to reinstate the loan contract or satisfy the amount of the loan in full.
