How do I prove Common Law Marriage?
By the conduct of both parties such as joint bank accounts, cohabitation (living together for a period of time), reputation, declarations, witnesses, and such other circumstances as usually accompany a marriage relationship. A mere promise or intent to marry in the future does not establish a common law marriage.
Am I entitled to Social Security benefits or benefits under the Veterans' Administration as a common law spouse?
Yes. Benefits for both are available to a spouse in states where common law marriage is recognized and where such benefits are available.
