How do I maintain or seek legal custody of my minor child?
First, you should understand your legal rights and obligations regarding your minor children. Then, if it appears to be in the best interest of the children, file a Custody Complaint with the County Court where you and/or the children reside, by incorporating it into a divorce proceeding, or by written agreement approved by the Court.


Can I receive legal custody of my children without filing a Complaint?
Yes. During any divorce or custody proceeding you may enter into a written agreement with the other party, file it with the Court and request that the Court approve and incorporate the agreement into your case.

Is it possible for both parents to have legal custody of a child?
Yes. Joint legal custody is generally by agreement between the parties, however, can be by Court Order. This is where the parties share both legal and physical custody of a child and assume equal responsibility for the child's welfare and expenses.

Is there a difference between legal custody and physical custody of a child?
Yes. Legal custody gives complete control over the child at any given time. Physical custody gives immediate control over the child while the child is with that parent.
